FOWLER – Sen. Tim Huelskamp (R-Fowler) announced today that he will introduce a Senate resolution in the upcoming legislative session condemning the recent EPA decision that classified carbon dioxide and other greenhouse gases as a danger to public health and paved the way for regulation, taxation, and litigation of carbon producers.
Sen. Huelskamp joins other Kansas leaders in their effort to resist the EPA decision. Rep. Jerry Moran has introduced legislation (H.J. Res 66) to rescind the EPA rule and Rep. Todd Tiahrt introduced an amendment to block any funding in an omnibus bill for Clean Air Act regulations based on the endangerment finding.
“This is a decision that clearly was made without taking into account the drastic economic consequences that it would have on the states, particularly a farm state like Kansas,” said Huelskamp. “And given that this unilateral decision circumvented the normal legislative process, it is yet another example of Washington being out-of-control.”
Sen. Huelskamp is also joining officials in states such as South Carolina, Texas, and Louisiana in sending letters to Lisa Jackson, administrator of the EPA, urging her to rescind her department’s decision.

Huelskamp states that “A unilateral ruling such as the one the EPA issued in this case circumvents the Constitutional balance of separation of powers and sets a dangerous precedent for our nation… During strenuous economic times, ordinary Kansans cannot afford to be hit with onerous regulations on our most crucial economic sectors.” You can view the letter by clicking here.
Sen. Huelskamp is a strong opponent of carbon and climate taxes and is the only candidate for Congress in the First District to take the “No Climate Tax Pledge.”
The legislative session begins January 11, 2010.
